Terms governing use of the MD Telemed telemedicine platform.

1. Acceptance of these terms

These Terms of Service ("Terms") govern your access to and use of the MD Telemed website, mobile experiences, and related services (collectively, the "Platform"). By creating an account, booking an appointment, or otherwise using the Platform, you agree to these Terms and to our Privacy Policy.

If you do not agree, do not use the Platform.

2. What the Platform provides

MD Telemed is a telemedicine platform that helps patients discover licensed healthcare providers, schedule virtual or in-person visits, participate in secure video consultations, receive clinical documentation when appropriate (including prescriptions where permitted by law), and manage related account activity such as payments and visit history.

Doctors and clinical staff use the Platform to manage availability, appointments, patient encounters, prescriptions, and professional profiles subject to administrative review. Platform features may vary by role (patient, doctor, or administrator) and by jurisdiction.

3. Eligibility and accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account, unless a parent or legal guardian creates and manages an account on behalf of a minor in compliance with applicable law.

You agree to provide accurate registration information, keep your credentials confidential, and notify us promptly of unauthorized access. You are responsible for activity that occurs under your account.

  • Patients may book appointments, complete onboarding and medical history forms, join video visits, view prescriptions, and manage billing where available.
  • Doctors must complete onboarding and remain subject to profile review and approval before certain dashboard features are enabled.
  • Administrative users access tools for platform operations as authorized by your organization.

4. Not for medical emergencies

The Platform is not intended for emergency care. If you believe you are experiencing a medical emergency, call your local emergency number (such as 911 in the United States) or go to the nearest emergency department immediately.

Clinical decisions are made by the treating provider during your visit. MD Telemed does not replace the professional judgment of your clinician.

5. Appointments, visits, and prescriptions

Appointment availability, visit format (virtual or in-person where offered), fees, and cancellation rules are displayed during booking and may depend on the selected provider and service.

You are responsible for joining visits on time, providing accurate health information, and following your provider's instructions. Prescriptions and treatment recommendations are issued only when clinically appropriate and in accordance with applicable law; not every visit results in a prescription.

Recording or redistributing visit content without consent may be prohibited by law and by provider policy.

6. Payments and refunds

Fees for services are shown before you confirm payment. You authorize us and our payment processors to charge the payment method you provide for confirmed bookings and related charges.

Refund and cancellation policies may vary by service and provider. Unless otherwise stated at checkout or required by law, completed consultations are generally non-refundable once the visit has occurred.

7. Acceptable use

You agree not to:

  • Use the Platform for unlawful, fraudulent, or abusive purposes.
  • Attempt to access another user's account or protected health information without authorization.
  • Interfere with Platform security, scrape data, or reverse engineer software except as permitted by law.
  • Upload malware or content that infringes intellectual property or privacy rights.
  • Misrepresent your identity, credentials, or clinical qualifications.

8. Relationship with healthcare providers

MD Telemed provides technology that facilitates care delivery. Licensed professionals who deliver care through the Platform are responsible for their clinical services. Nothing in these Terms creates a doctor–patient relationship between you and MD Telemed as a technology provider.

Provider participation, credentialing, and ongoing approval may be managed through our administrative processes.

9. Intellectual property

The Platform, including its design, software, logos, and content provided by MD Telemed, is protected by intellectual property laws. We grant you a limited, non-exclusive, revocable license to use the Platform for personal or authorized professional purposes in accordance with these Terms.

10. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, OR THAT THE PLATFORM WILL MEET EVERY CLINICAL NEED.

Information on the Platform is for general platform use and is not a substitute for professional medical advice, diagnosis, or treatment.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MD Telemed AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE PLATFORM WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO US FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE EVENT OR (B) ONE HUNDRED U.S. DOLLARS ($100), EXCEPT WHERE SUCH LIMITATIONS ARE PROHIBITED BY LAW.

12. Suspension and termination

We may suspend or terminate access if you violate these Terms, pose a security risk, or as required by law. You may stop using the Platform at any time. Patients may also request account deletion through in-app privacy settings, subject to legal retention requirements for health records.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date. Continued use after changes become effective constitutes acceptance of the revised Terms.
